How to ensure quality representation regardless of firm size
Whether your attorney is a solo practitioner or part of a large firm, these steps help ensure you receive competent representation.
Before hiring
- Meet with the attorney (not just staff) before signing anything
- Ask who will actually handle your case day-to-day
- Get a clear, written fee agreement
- Check the attorney's bar status and disciplinary history
- Ask about their caseload and how they manage it
- Consult with at least two or three attorneys before deciding
During your case
- Review every document before it is filed -- you sign under penalty of perjury
- Monitor your docket on PACER periodically
- Keep copies of all correspondence and documents
- Document all communications with the firm
- Ask questions about anything you do not understand
If problems arise
- Raise concerns in writing immediately
- Escalate to firm management if your attorney is unresponsive
- Contact the U.S. Trustee's office if you believe filings contain errors
- Contact the state bar if ethical rules are being violated
- Consult another attorney if you are considering a change
Your most important tool: Review your petition and schedules carefully before signing. You are signing under penalty of perjury that the information is true and correct. If something is wrong, insist it be corrected before filing.
